1. Acceptance of Terms
By submitting an application, signing a service order, or sending, receiving, or routing any traffic across CallONet's network ("Services"), you ("Customer," "you") agree to be bound by these Terms of Use ("Terms"), any applicable service order, and any policies referenced herein, including our Privacy Policy. If you do not agree, do not use the Services. These Terms form a binding agreement between you and CallONet, with a mailing address at 124 W Capitol Ave, Suite 408, Little Rock, AR 72201 ("CallONet," "we," "us").
2. Eligibility & Service Scope
CallONet provides wholesale, business-to-business telecommunications and lead generation services within the United States only. The Services are not offered to individual consumers for personal, family, or household use, and are not offered for traffic originating or terminating outside the United States except where CallONet expressly enables outbound international (A-Z) termination as a distinct add-on.
- You must be a legally formed business entity or sole proprietorship authorized to operate in the United States.
- You must have a lawful, legitimate business purpose for the traffic or leads you send, receive, or request through CallONet.
- You are responsible for ensuring your own downstream customers, resellers, or agents comply with these Terms if you resell or sub-provision Services.
3. Account Registration & Verification
CallONet performs identity and business verification ("KYC") on all applicants before provisioning live traffic, and may periodically re-verify existing accounts. You agree to:
- Provide accurate, current business registration, contact, and billing information;
- Promptly update your account information if it changes;
- Designate an authorized point of contact responsible for compliance with these Terms; and
- Cooperate with reasonable requests for documentation supporting your traffic type, call flows, or lead-generation consent practices.
CallONet may decline, delay, or condition provisioning on the outcome of this review at its sole discretion, and may request additional information at any time if traffic patterns change materially from what was disclosed at signup.
4. General Acceptable Use
In addition to the traffic-specific standards in Section 5, you agree not to use the Services to:
- Violate any applicable federal, state, or local law or regulation;
- Infringe the intellectual property, privacy, or other rights of any third party;
- Transmit malicious code, attempt unauthorized access to CallONet's network, or interfere with the integrity or performance of the Services;
- Resell Services to a party CallONet has previously suspended or terminated for policy violations; or
- Misrepresent your identity, business purpose, or traffic type during onboarding or at any time thereafter.
5. Network Traffic Standards (Bad Traffic Policy)
This Section 5 is the detailed, controlling policy for how CallONet defines, detects, and addresses harmful, fraudulent, or unlawful traffic ("Bad Traffic") on its network. It applies to all origination and termination traffic, and, where relevant, to outbound calling or texting conducted using leads obtained through CallONet's lead generation service.
5.1 Definition of Bad Traffic
"Bad Traffic" means any call, text, or signaling activity sent, received, or attempted over CallONet's network that falls into one or more of the following categories:
- Unlawful robocalls. Autodialed or prerecorded voice calls placed without the consent required under the Telephone Consumer Protection Act (TCPA) or equivalent state law, including calls to numbers on the National Do-Not-Call Registry absent an applicable exemption.
- Caller ID spoofing. Transmission of inaccurate, unauthorized, or misleading calling party number (CPN) or Caller ID information with intent to defraud, cause harm, or wrongfully obtain anything of value, in violation of the Truth in Caller ID Act.
- Illegal telemarketing. Outbound sales or solicitation calls that violate the Telemarketing Sales Rule (TSR), including failure to honor do-not-call requests, prohibited call times, or missing required disclosures.
- Toll fraud & PBX hacking. Traffic generated by compromised customer premises equipment, unauthorized access to a PBX or softswitch, or International Revenue Share Fraud (IRSF) schemes.
- Traffic pumping / access stimulation. Artificially inflating call volume to specific rate centers or numbers to generate improper access or termination charges.
- Wangiri and one-ring scams. Traffic designed to induce return calls or callbacks to premium-rate or high-cost numbers.
- Impersonation & deceptive robocalls. Calls that impersonate government agencies, financial institutions, or other businesses to deceive recipients, including scam and phishing ("vishing") campaigns.
- Unauthorized or unconsented lead-based outreach. Use of leads obtained through CallONet's lead generation service for calls or texts without the consent or documentation required under applicable law.
- Nuisance and harassment traffic. Repeated, high-volume, or automated calls intended to harass, annoy, or abuse call recipients, regardless of commercial intent.
- Invalid, unassigned, or malformed numbering. Use of North American Numbering Plan (NANP) resources in a way inconsistent with numbering authority rules, including use of unassigned, reserved, or improperly formatted numbers as calling party identification.
5.2 Caller ID & Signaling Requirements
All traffic originated on CallONet's network must present accurate, authorized Caller ID information that the sending party is entitled to use. Where SHAKEN/STIR signing is available on a route, CallONet applies and preserves attestation information consistent with industry standards, and customers may not intentionally strip, alter, or falsify attestation-related signaling to disguise the true origin or nature of a call.
5.3 Consent & Documentation Obligations
Customers making outbound autodialed, prerecorded, or telemarketing calls, or using CallONet-generated leads for outbound contact, must be able to produce, upon request, records demonstrating the legal basis for contacting each recipient (for example, prior express written consent, an established business relationship, or an applicable regulatory exemption). Failure to produce adequate documentation within the timeframe requested by CallONet may be treated as a violation of this policy.
5.4 Volume, Pacing & Time-of-Day Limits
CallONet may apply reasonable technical controls to outbound traffic, including call-pacing limits, concurrent call caps, and restrictions on calling outside the hours permitted under the TSR (generally 8:00 a.m. to 9:00 p.m. local time of the called party) for telemarketing-type traffic. Customers must configure their dialing systems to honor recipient time zones and applicable calling-time restrictions.
5.5 Prohibited Destinations & Number Lists
Customers must not knowingly place calls to: numbers on the National Do-Not-Call Registry absent a valid exemption or established business relationship; numbers on CallONet's internal do-not-call or complaint list; emergency service lines for non-emergency purposes; or numbers where the recipient has directly revoked consent to be contacted.
Zero tolerance for confirmed fraud. Confirmed instances of toll fraud, IRSF, traffic pumping, or intentional Caller ID spoofing for deceptive purposes result in immediate suspension without prior warning, in addition to any other remedies available to CallONet under these Terms or applicable law.
6. Monitoring, Detection & Enforcement
CallONet actively monitors traffic on its network using a combination of automated and manual methods, including:
- Real-time analytics tracking call volume, velocity, average call duration, answer-seizure ratio (ASR), and post-dial delay (PDD) at the account and route level to flag statistically anomalous patterns consistent with robocalling, fraud, or traffic pumping.
- Caller ID integrity screening to detect invalid, unassigned, or unauthorized calling numbers, including comparison against known-valid number inventories where available.
- Complaint intake from call recipients, downstream carriers, the USTelecom Industry Traceback Group, state attorneys general, and the FCC or FTC, which is logged and matched against account-level traffic records.
- Honeypot and canary numbers used to help detect unlawful autodialed or spoofed traffic traversing partner networks.
- Periodic account audits comparing actual traffic patterns to the use case and volume disclosed at onboarding, with follow-up review triggered by significant deviations.
Where CallONet identifies traffic reasonably believed to be Bad Traffic, it will generally follow an enforcement ladder proportional to severity, though CallONet reserves the right to bypass any step for severe or repeated violations:
- Flag & investigate — the affected traffic or account is placed under review, which may include temporary enhanced monitoring.
- Written warning & remediation window — the customer is notified of the specific concern and given a defined period (typically 24–72 hours, or shorter for severe issues) to remediate and respond.
- Route throttling or restriction — CallONet may reduce concurrent call limits, cap volume, or restrict specific routes or destinations while the issue is resolved.
- Suspension — the account or specific service is suspended pending investigation or confirmed resolution.
- Termination & reporting — confirmed, uncured, or severe violations result in permanent termination of Services, forfeiture of any prepaid but unused balances associated with the violating traffic to the extent permitted by law, and may be reported to relevant carriers, industry traceback groups, and regulators.
7. Customer Reporting & Traceback Cooperation
Customers must promptly report to CallONet any known compromise of their systems (such as a hacked PBX), any credible indication that their traffic has been used to originate Bad Traffic, and any regulatory inquiry or subpoena they receive relating to traffic sent through CallONet. Customers agree to cooperate in good faith with CallONet's response to traceback requests from carriers, industry consortiums, or government authorities, including by providing call detail records and account information relevant to the specific traffic identified in the request, within the timeframe reasonably specified by CallONet.
8. Fees, Billing & Payment
Fees for Services are set out in your service order or rate deck and are subject to change with notice as described in that order. Invoices are due on the terms stated in your service order; overdue balances may result in suspension of Services. You are responsible for all applicable taxes and regulatory surcharges unless otherwise stated. CallONet may withhold or offset amounts owed to you against confirmed losses caused by your Bad Traffic, including fraud-related termination or access charges billed to CallONet by upstream carriers.
9. Service Availability & Support
CallONet designs its network for high availability using redundant points of presence and continuous route monitoring, but does not guarantee uninterrupted or error-free service. Specific service-level commitments, if any, are set out only in a signed service order or service-level agreement and are not created by marketing statements on this website.
10. Intellectual Property
CallONet retains all right, title, and interest in its network, software, documentation, and branding. These Terms grant no license to CallONet's intellectual property except the limited right to use the Services as provided herein.
11. Confidentiality
Each party agrees to protect the other's confidential information disclosed in connection with the Services using at least the same degree of care it uses for its own confidential information, and not to disclose it to third parties except as required to perform under these Terms, comply with law, or respond to a lawful traceback or regulatory request as described in Section 7.
12. Disclaimer of Warranties
Except as expressly stated in a signed service order, the Services are provided "as is" and "as available." CallONet disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
13. Limitation of Liability
To the fullest extent permitted by law, CallONet will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost business, arising from or related to the Services, even if advised of the possibility of such damages. CallONet's total aggregate liability under these Terms will not exceed the fees paid by you for the Services giving rise to the claim during the three (3) months preceding the event giving rise to liability.
14. Indemnification
You agree to indemnify, defend, and hold harmless CallONet, its officers, employees, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your breach of these Terms, including the Network Traffic Standards in Section 5; (b) Bad Traffic originated, terminated, or facilitated through your account; (c) your violation of applicable law, including the TCPA, TSR, or Truth in Caller ID Act; or (d) claims brought by your own customers, resellers, or lead recipients relating to your use of the Services.
15. Term, Suspension & Termination
These Terms remain in effect while you use the Services. CallONet may suspend or terminate Services immediately for suspected or confirmed Bad Traffic, non-payment, or other material breach, and may terminate for convenience on notice as specified in your service order. You may terminate by providing notice as specified in your service order. Sections that by their nature should survive termination (including Sections 5, 7, 11, 12, 13, and 14) will survive.
16. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-laws principles. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the state or federal courts located in Pulaski County, Arkansas, unless otherwise specified in a signed service order.
17. Changes to These Terms
CallONet may update these Terms from time to time to reflect changes in law, industry standards, or our Services. Material changes will be reflected by an updated "Last updated" date above, and, where required by your service order, by direct notice. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
18. General Provisions
If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. These Terms, together with your service order and referenced policies, constitute the entire agreement between you and CallONet regarding the Services and supersede prior agreements on the same subject matter. CallONet's failure to enforce any provision is not a waiver of its right to do so later.
